 Social Security disability claims are notoriously difficult to get approved.  In fact, the Social Security Administration (SSA) will deny 7 out of 10 disability claims for one reason or another.  But here are 5 good predictors that your claim may be approved on the first try:

 1.  You are not presently able to work and your doctor has told you that you must be off work for at least 12 straight months or longer.

2.  You have a solid history of employment.  An excellent work record will have only a few different jobs, each lasting years; good wages and no long periods of unemployment (whatever the reason).  

 3.  Your doctor has provided a Medical Source Statement (MSS) or Residual Functional Capacity (RFC) which explains specific work-related medical limitations in terms of work activities.

4.  You have good medical treatment and there are adequate records showing the nature and severity of your illnesses/injuries, and that you have followed your doctor's treatment recommendations without significant improvement.

5. You have hired a Social Security disability attorney or professional non-attorney advocate.  Either of these individuals will know Social Security laws, rules and procedures--and how to handle your claim to your best advantage.

If these major indications are in place, you have an excellent chance of being approved--on  appeal, if not at the initial application level.  If it takes a long time to get approved, your attorney/advocate may ask for back pay for each month you've waited on Social Security to decide.

There is a lot of talk and speculation about Social Security in the new Trump Administration.  The acting commissioner of Social Security recently resigned and Lee Dudek has been appointed the new Acting Director. Today (2/18/2025) I received a message from the new Acting Commissioner Dudek.  Here is part of Director Dudek's message on Social Security for 2025:   Our continuing priority is paying beneficiaries the right amount at the right time, and providing other critical services people rely on from us. DOGE personnel CANNOT make changes to agency systems, benefit payments, or other information. They only have READ access. SOCIAL SECURITY DISABILITY APPLICATION PROCESS

  Here is a brief overview of what takes place after you file your Social Security disability application : Application confirmation  – Social Security will mail you a copy of your application to sign. You will have an opportunity to review the application, correct any errors, and send it back to Social Security for processing. You must return the signed application. Social Security will not process your application until they receive your signed confirmation. And they don't send reminders about this.
